Privacy Policy

This Privacy Policy describes how Eljam PTY LTD (ACN 690 099 382), trading as Healthly ("Healthly", "we", "our", "us") collects, uses, stores, and protects your personal information. Healthly is based in Cardiff, NSW, Australia, and is committed to complying with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).

By using our app ("the App") or website ("the Site"), you agree to the terms of this Privacy Policy.

1. Information We Collect

We may collect the following types of information:

  • Personal information: name, email address, contact details, account login credentials.
  • Health and nutrition information: data you enter into the App such as food logs, body weight, and related information.
  • Optional progress photos: starting or progress photos you choose to upload through an authenticated Healthly programme, together with your separate marketing-consent choice and its timestamp.
  • Optional challenge reflections: written responses or a video you choose to save at the end of a Healthly programme, together with any separate testimonial-consent choice and its timestamp.
  • Missing product information: when you choose to add details for a product our scanner does not recognise, we may collect the product photos, barcode, product name, brand, ingredients, and nutrition details you provide.
  • Website information: cookies, usage data, analytics, and information you provide via forms on the Site.
  • Purchase and advertising information: the product purchased, transaction value and currency, purchase status, advertising campaign information, and identifiers used to measure whether advertising contributed to a visit or purchase.
  • Communication information: enquiries, feedback, and support requests.

You may choose not to provide personal information. However, this may prevent us from providing some services to you.

2. How We Use Information

We use your information to:

  • Provide, maintain, and improve the App and the Site.
  • Personalise your experience and deliver nutrition tracking features.
  • Store optional progress photos so you can review or compare them later.
  • Use progress photos in Healthly marketing only when you have separately given explicit consent.
  • Store an optional challenge reflection and use it as a testimonial only when you have separately given explicit consent.
  • Respond to enquiries and provide customer support.
  • Communicate with you about updates, features, or promotions (you may opt out at any time).
  • Measure visits, checkout activity, purchases, and the effectiveness of our advertising.
  • Comply with legal obligations.

3. Disclosure of Information

We do not sell your personal information. We may disclose information to:

  • Trusted third-party service providers that process Healthly data for us, such as hosting, analytics, and payment providers.
  • Meta, for advertising measurement and attribution as described in section 5 below. We do not send your food logs, body weight, nutrition information, private access links, or support messages to Meta for this purpose.
  • Public food databases, but only when you choose to add details for a missing product, so the product photos and details you provide can improve future scanning for you and other users.
  • Professional advisers, insurers, or regulators where legally required.
  • Other parties with your consent.
  • Display progress photos in the marketing channels described when you have explicitly consented to that use.
  • Display a written or video challenge reflection as a testimonial when you have explicitly consented to that use.

4. Data Storage and Security

We take reasonable steps to protect your personal information from misuse, interference, loss, unauthorised access, modification, or disclosure. While we use industry-standard safeguards, no method of transmission or storage is completely secure.

5. Cookies and Analytics

The Site uses essential storage needed to operate the Site. If you choose Allow advertising cookies, we also load the Meta Pixel on our public marketing and challenge pages. It measures page views, content views, and checkout starts and may use Meta browser identifiers such as _fbp and _fbc. You can decline these cookies or change your choice through Cookie choices in the Site footer.

We use RevenueCat to process challenge checkout and purchase records for Healthly. When you complete a challenge purchase, Healthly reports a server-side Purchase event to Meta through RevenueCat so we can measure our ads. It includes the product, value, currency, and your email for matching. This happens independently of your browser-cookie choice. We do not send Meta your food logs, weight, nutrition information, private links, or support messages. Meta and RevenueCat may process this information outside Australia.

6. Data Retention

We retain personal information for as long as necessary to provide our services and comply with legal requirements. When information is no longer required, we will take reasonable steps to delete or de-identify it.

Where the relevant programme provides controls, you may delete uploaded progress photos or a reflection video and withdraw future marketing or testimonial consent from your account. You can also contact us using the details below.

7. Access and Correction

You may request access to the personal information we hold about you and request corrections if it is inaccurate, out of date, or incomplete. Requests should be directed to us using the contact details below.

8. International Transfers

Some of our service providers may store or process information outside Australia. Where this occurs, we take reasonable steps to ensure your information is handled in accordance with this Privacy Policy.

9. Changes to This Policy

We may update this Privacy Policy from time to time. The latest version will always be available on the Site, with the "Effective Date" updated accordingly.
